A mutual benefit non-profit corporation is formed solely for the benefit of its members. Examples include labor unions, teachers associations, community clubs, and veterans groups

To qualify for exemption as a 501(c)(3) organization, the following activities are prohibited:

  • Supporting or opposing candidates in political campaigns in any way

  • Attempting to influence legislation

  • Furthering non-exempt purposes (such as purposes that benefit private interests) more than insubstantially

  • Organizing or operating for the primary purpose of conducting a trade or business that is not related to the exempt purpose(s)

  • Providing commercial-type insurance as a substantial part of its activities

  • Using net earnings to benefit private shareholders or individuals (that is, board members, officers, key management employees, or other insiders)
